Terms and conditions

A submitted booking is considered a contract under the following terms and conditions.

Parties

The “tenant” is defined as the person submitting the booking using this website.

The “landlord,” or “landlords,” is/are defined as the private persons Lill Schiöld and Mikael Schiöld.

Deposit

After a booking has been submitted by the tenant, using the booking form made available on this website, a deposit of 25% of the total rental cost shall be paid by the tenant to the landlord, which shall be transferred within 7 days to the landlord’s account as described in the emails sent to the tenant in connection with his/her booking.

The remaining amount shall be transferred by the tenant to the same account no later than three weeks before the start of the rental period.

If the agreed amount has not been received in said account by this time, the landlord may terminate the agreement immediately. The landlord reserves the right to compensation from the tenant for the resulting damage, by way of the 25% deposit accruing to the landlord.

Cancellation

If cancellation occurs less than 2 weeks before the start of the rental period, the deposit shall accrue to the landlord as compensation for the lack of performance on the part of the tenant. The remaining amount paid shall be refunded to the tenant.

 

If cancellation occurs earlier than 2 weeks before the start of the rental period, the entire amount paid shall be refunded to the tenant.

 

In the event of an interrupted stay by the tenant, for whatever reason, no part of the entire amount paid will be refunded; the entire amount paid accrues to the landlord as compensation for the lack of performance on the part of the tenant.

 

In the event of an interrupted stay by the landlord, caused by the landlord, the entire amount paid shall be refunded to the tenant.

 

In the event of an interrupted stay by the landlord, caused by the tenant, no part of the entire amount paid will be refunded; the entire amount paid accrues to the landlord as compensation for the lack of performance on the part of the tenant.

 

Unlawful, disturbing or otherwise unacceptable conduct by the tenant(s) will result in immediate termination of the agreement, and no part of the entire amount paid will be refunded; the entire amount paid accrues to the landlord as compensation for the damage caused by the tenant.

 

Unlawful conduct will be reported to the police.

Damages

Tenant’s responsibilities

 

In the event of damage to chattel in or around the house, caused by the tenant, the tenant undertakes to pay €500, in addition to all previously paid amounts, for such damages.

 

In the event of damage to the house itself, or the property, caused by the tenant, the tenant undertakes to pay for all costs for repair of such damages, whatever such costs may be, in addition to all previously paid amounts, even if such repairs will entail rebuilding the entire house from the ground up.

 

The tenant also undertakes to immediately notify the landlord of any damage to or in the house not caused by him/her. Such damages are intended as informative to the landlord for maintenance purposes, and will not be charged to the tenant.

 

Landlord’s responsibilities

 

The house and the property are provided for rent as is.  The tenant uses the house, the property and other objects provided by the landlord at his own risk.

 

No responsibility will be taken by the landlord for items brought by the tenant to the house, and no compensation can accrue to the tenant thereby.

 

The tenant’s claims for damages are excluded as far as legally possible.

 

The landlord cannot be held responsible for disturbances caused by people, nature or technology that are outside of the landlord’s sphere of influence and which are therefore beyond the landlord’s control.

Jurisdiction and laws in case of dispute

All disputes between the parties to this rental agreement shall be tried in Swedish courts, under Swedish jurisdiction and under applicable Swedish laws.

Cleaning

The tenant is responsible for the house being cleaned before check-out. Cleaning materials are made available by the landlord.  The house is expected to be in the same shape or standard upon departure as it was upon arrival.

Keys and passwords

Information regarding the housekey and password to the WiFi will be provided to the tenant by the landlord upon receipt of payment of all remaining amounts for the booking.

Relevant rules and laws

The tenant is reminded to follow these rules and laws with special care during their stay in the house:

Fire indoors

It is forbidden to light fires indoors, with the exception of lighting ordinary table candles. At the moment, it is forbidden to light fires in the fireplace in the living room because the flue or smokestack is not airtight and candle-grease has gotten into it, which makes a nasty and possibly toxic smelling smoke spreading throughout the house when burning fires in the fire place. Therefore, it is especially forbidden to make fires in the fireplace. There are plans to replace both the stove and flue in the future.

 

Burning candle lights must not be left unattended!

Fire outdoors

In compliance with EU directives, Sweden has issued a ban on outdoor fires from 2024-01-01. This means that you can light a fire in a regular barbeque outdoors, but you are not allowed to light an open fire outdoors. This is not only because of the risk of the fire spreading, but also because of new environmental laws in Sweden prohibiting emissions of carbon dioxide.

 

During certain extreme periods of drought, the authorities also issue bans against all types and forms of outdoor barbeques. On such occasions, the landlord will specifically inform the tenant of the prevailing bans on fires.

Dogs

The Uthammar Udde Association has issued a rule, which states that dog owners must keep their dogs on a leash during dog walks in the area, and at all times, including at the house, to always keep their dog under direct supervision.  Under Swedish laws, dog owners are legally responsible for the behavior and acts of their dog.

Dogs are not allowed to swim at Uthammar’s sandy beach, where people swim. There is a dog bath a little further on from the sandy beach; you walk about 50 meters on a small trodden path along the shore until you reach the end of the bay before the giant boulder.  There, dogs can swim.

Dogs can also swim at the rocks in Uthammar’s harbor, next to the bathing jetty.

Dog poop

When walking dogs in the area, as well as on the property around the house, the tenant must pick up any possible dog poop left by their dog, tie it up in a plastic bag and throw it in the garbage can that belongs to the house.

Garbage can

The garbage can is located on the side of the street at the entrance of the house property.  The white identification tag on the side of the garbage states “Segelvägen 27” (not to be mistaken by the neighbor’s garbage can standing next to it(!)).

Garbage disposal

We Swedes are crazy about sorting our garbage…

 

Oskarshamn’s Municipality has issued ordinances governing waste management, to which the tenant must adapt and follow to the letter(!).

 

Plastic, paper, glass and metal must be separated from other household waste and must then be sorted separately.

 

The landlord provides 4 containers in which the tenant must dispose the respective plastic, paper, glass and metal objects to be discarded. The landlord is then responsible for emptying these 4 containers once a week (usually on saturdays) and after the end of the tenant’s stay, or in accordance with other agreement made between landlord and tenant for longer stays.  If the rented period is 3 weeks or longer, the tenant is responsible for emptying these 4 recycling containers at the Recycling Station in Figeholm.

The containers for sorting waste are located in the utility room on the far short side of the house, which has an external door.

 

The tenant must put organic food waste in green colored plastic bags, which must be tied before placed in the garbage can belonging to the house.

 

The tenant must put all other household waste in red colored plastic bags with a tie before placing in the garbage can belonging to the house.

 

The landlord will provide the house with colored plastic bags for household waste disposal.

 

VERY IMPORTANT: NO LOOSE GARBAGE, TRASH, GARDEN WASTE, FISH GUTS/BONES, GLASS, METAL, PAPER, PLASTIC OR OTHER LOOSE ITEMS MAY BE THROWN IN THE GARBAGE CAN BELONGING TO THE HOUSE! The municipality will not empty the garbage can unless ALL garbage, which is allowed to be thrown in the garbage can, is packaged in tied colored plastic bags.

 

-Remember: Everything always in a colored plastic bag with a knot on it!  NOTHING ELSE in the garbage can!

Toilet disposal

Please, do NOT flush tampons, pads, cotton swabs or diapers in the toilet!  The sewage system simply cannot handle such items.

Right of public access

When you are out in nature in Sweden, there is a unique law governing the right of public access called Allemansrätten. The heart of the rule is: “Do not disturb, do not destroy”. In other words, we can go almost anywhere in nature and on other people’s property as long as we don’t disturb or destroy. But there are some exceptions. We must not walk on growing crops and we must respect the peace of the home zone. Boats and docks

Boats for fishing or recreation can be rented at Figeholms Marin.

Rental costs for boat rentals are not included in the rental costs for Villa Ängen.  The tenant is responsible for all rental costs for any boat rented by the tenant while renting Villa Ängen.

Information regarding the dock number on the jetty in the Uthammar Marina will be provided to the tenant by the landlord upon receipt of payment of all remaining amounts for the booking.

 

The dock on the jetty in the Uthammar Marina  is provided as is. 

 

The tenant uses the dock provided by the landlord at his/her own risk.

 

No responsibility will be taken by the landlord for items brought by the tenant to the dock or to his/her boat, and no compensation can accrue to the tenant thereby.

 

It is the tenant’s responsibility to make sure his/her boat is properly tied up while docked, so as to not damage nearby boats, the dock or his/her own boat, whether tied up at the landlord’s dock or while tied up to any other dock at any other place.

 

The tenant is responsible for all damages caused by him/her in connection with his/her use of his/her boat, while docked or while out at sea, including all damages caused to his/her own boat or to persons in or around his/her boat.

 

The landlord makes available some life jackets for use by the tenant. If these life jackets are not enough, in number, size or standard, then it is the tenant’s responsibility to obtain the proper number, size or standards of life jackets.

 

It is the tenant’s responsibility to ensure that all life jackets are the proper size and standard of life jackets.

 

The landlord takes no responsibility for any damage, whether to persons or property, caused by the tenant in connection with his/her use of his/her boat, while docked or while out at sea.  

 

The tenant’s claims for damages in connection with his/her use of his/her boat are excluded as far as legally possible.

 

The tenant is reminded hereby to use life jackets at all times while at sea or while close to the water.  

Fishing

In the waters around Virbo south of Figeholm, fishing is prohibited all year round. (The area on the water marked in green on the map below). During certain other seasons, fishing is prohibited in other water areas to protect birdlife. (The areas marked in red on the map below). The Coast Guard patrol the waters and severe fines are issued by the authorities for violations.

 

Otherwise, so called “free hand gear fishing” is permitted.   The County Board for Kalmar County defines this as follows:

 

Along the coasts of Kalmar county, it is permitted to fish with hand gear (rod, jig and similar mobile gear equipped with a line and a maximum of 10 hooks) on individual waters. Trolling is not included in the free hand gear fishing.

 

Fishing is prohibited with pointed gear such as e.g. rakes and lights, long-handled grappling hooks, explosives, anesthetic or lethal substances, electric current or firearms (also applies to harpoon guns). However, it is permitted to salvage already caught fish with a grappling hook.

It is not necessary to hold a fishing permit for hand gear fishing along the coast.  However, along the coast a minimum and maximum size for pike and zander or pike-perch apply, only fishes between 40 cm and 75 cm may be taken along the coast. You are also allowed to take up a maximum of 3 fish per day, regardless of type.

Fish guts and bones

The tenant must clean all caught fish down by the sea and throw all fish guts and bones into the sea before bringing the fish up to the house. Fish guts and bones may not be thrown anywhere else, either in the Uthammar area or around the house.
